Privacy policy

The purpose of this Privacy Policy is to describe how GLOBAL INTELLIGENCE (GI), as a Controller, uses and shares the personal information you entrust to us through engaging our services on our website. 

Please read this Policy carefully before using our Service. If for any reason you do not accept and agree to the terms forth in this Policy then accessing the Service is strictly prohibited and you must immediately exit.

Please note that data transmitted via the internet (e.g., via email communication) may be subject to security breaches. Complete protection of your data from third-party access is not possible.

Our Services are not targeted for use by children (persons under eighteen years old). We will not knowingly request or collect personal information from a child. If you are under eighteen years old, please do not provide your information on our Site. Upon notification that a child has provided us with personally identifiable information, we will delete the child’s personally identifiable information from our records as permitted by law. 1. Source of personal data

We process personal data that you provide to us when you interact with or use our Services; create or modify your account on our website (the “Site”); purchase Services from us; request information from us; contact customer support; or otherwise communicate with us; visit our Site (through use of cookies and similar technologies).

2. Categories of personal data

As a Controller it is possible for us to process the following categories of personal data (the intention is for the list to be exhaustive, but not all these data will be processed in all cases):

• • contact information, including your first name, last name, company name, address, email address, and telephone number; authentication information, including the user name and password that you use to register an account on the Site;
  • for payment processing purposes: financial information, including your debit or credit card number, name on card, its expiration date and its security code, also: street address, postal code/Zip code, city, country, company name, VAT number;
  • communications you send us;
  • online behavior information including online activity, preferences, and time spent viewing features;
  • IP address, mobile network information, or device information.

All this information, except for the Credit/Debit Card data, is securely stored on the motionmask cloud servers. The Credit/Debit Card information is stored on a third party’s electronic system, owned and managed by the payment processing company.

3. Purposes of the processing and legal basis for the processing

We process your personal data based on the following legal basis:

• • to comply with a contract or to act in relation to a contract: this is relevant if you register to use our Services. Here are included:
    • making available to you the Services that you have requested;
    • verifying your identity;
    • payment processing;
    • sending necessary communications (for example, related to payments or the expiration of your subscription) and
    • providing customer service or support.
      
      
  • based on our legitimate interests, in particular:
    • analyzing usage and measuring the effectiveness of the Services to better understand how they are used so we can improve them;
    • send information about our products and services, special offers and similar information;
    • analyzing your use of our services and your interaction with our communications, to tailor and personalize them and marketing communications;
    • detect, prevent, or otherwise resolve fraud, security, or technical issues, and protect against harm to our rights, property, or safety, our users, or the public at large;
    • carrying out surveys and market research about our customers, their interests, the effectiveness of our marketing campaigns and customer satisfaction;
    • investigating and responding to any comments or complaints submitted by you;
    • for the purposes of legal, compliance, regulatory and investigative claims, as applicable (including disclosure of information related to requests from administrative institutions, lawsuits or litigation).

If we process your information based on legitimate interests, you can object to this processing in certain circumstances. In such situations, we will stop processing the information, except where we are obliged for legitimate or legal reasons to continue processing.

• • based on your implicit or explicit consent for:
    • in some cases, sending information about our products and services, special offers and similar information and sharing the information with third parties for their own marketing purposes;
    • placing cookies and using similar technologies;
    • the opportunity for you to participate in contests and similar promotions and to administer these activities.

You are not obliged to provide us with your personal data. However, if you do not consent to the processing of your data for certain purposes, e.g., by setting certain cookies, you may not be able to use all the functions of this website.

You have the right to withdraw at any moment the consent granted, without, however, the legality of the processing carried out to that point being affected. • • for legal reasons:
    • responding to requests from public authorities;
    • use or disclosure of information, to the extent necessary to detect, prevent or otherwise address problems associated with fraud, security, possible illegal activity or technical problems and software piracy.

4. Retention period

In general, we will process your personal data as much as it is necessary for the processing purposes mentioned above (including by applicable laws), except for the situations in which the legal provisions foresee or oblige otherwise. Therefore, personal data will be stored:

• • as long as your user account is active, subsequently for the period necessary to evidence the operations carried out through the user account;
  • if you choose to deactivate your user account, we would like to inform you that disabling your account will not automatically delete your personal data. If you want us stop processing your personal data or if you want your data deleted, you may exercise your rights detailed under section 5 below;
  • up to one year for messages where you ask for details or support through our chatbot, email, post, dedicated support forms or our call center, regardless that your request came by electronic or mail means, in writing or audio;
  • up to 3 years for performing analysis regarding the navigation on our sites and your interactions with our sites;
  • for the duration provided for by law in situations where there are applicable legal provisions in this respect (e.g. in case of mandatory accounting books and supporting documents underlying financial accounting records).

5. Your rights as Data Subject

In your capacity as Data subject, you have the following rights:

• • to access your data – you can get information on your personal data processing, as well as a copy thereof;
  • to rectification– you can request that your personal data should be completed or updated, in case such is inaccurate or incomplete;
  • to be forgotten – in certain situations, you can request erasure of your personal data;
  • to restriction of processing – in certain cases, you can request conditional processing of your personal data until settlement of certain operations concerning your data.;
  • to object – in case of processing for legitimate interests, you are lawfully entitled to object to such processing;
  • data portability – you can request the personal data you provide be transferred and processed through automated means in a structured, automated and readable format.

Each of the rights here above can be exercised by sending a written request, dated and signed, to the head office of GI, located in Street Frunzei 26, Floor 1, Room 1 , Bucharest, Romania or at the e-mail address: privacy@motionmask.ai Should you deem that your rights have not been observed, you can contact our Personal Data Protection Officer at the e-mail address hereabove or you can lodge a complaint with the National Authority for Personal Data Supervision and Processing (ANSPDCP).

6. Data transfer

Personal data are processed strictly on the territory of Romania and there is no intention to transfer personal data to third countries or to international organizations. In the unlikely event that a transfer might be necessary, the Controller will ensure either that the transfer is made to a country that ensures an adequate level of protection, or will take additional adequate guarantees to protect your personal data, such as the implementation of standard contractual clauses approved at the European level or binding corporate rules.

Hotjar

We use Hotjar in order to better understand our users’ needs and to optimize this service and experience. Hotjar is a technology service that helps us better understand our users’ experience (e.g., how much time they spend on which pages, which links they choose to click, what users do and don’t like, etc.) and this enables us to build and maintain our service with user feedback. Hotjar uses cookies and other technologies to collect data on our users’ behavior and their devices, based on your consent, Article 6 (1) lit. a GDPR. This includes a device’s IP address (processed during your session and stored in a de- identified form), device screen size, device type (unique device identifiers), browser information, geographic location (country only), and the preferred language used to display our website. Hotjar stores this information on our behalf in a pseudonymized user profile. Hotjar is contractually forbidden to sell any of the data collected on our behalf. As a user of a website that is using Hotjar you have the right to view and delete information collected about you.

7. Changes to this policy

We reserve the right, at any time and without notice, to add to, change, update, or modify this Policy, simply by posting such change, update, or modification on our Site. Any such change, update, or modification will be effective immediately upon posting. By continuing to use our Site and Service after any changes are made, you understand and agree to be legally bound by such changes and the then-current privacy policy. If any changes made are significant, we will provide a more prominent notice. However, by using our Site, you understand and agree that it is your responsibility to be familiar with this Policy, as it may be amended from time to time, and to review this Policy for any changes, updates, and modifications.
